Aarushi case may come up in Ghaziabad court Jan 3

GHAZIABAD - A Ghaziabad court would take up the Central Bureau of Investigation’s (CBI) closure report in the Aarushi Talwar murder case Jan 3, 2011 when it reopens after vacation, local lawyers said Thursday while slamming the probe agency.

The CBI filed its final report in the case in a Ghaziabad special court on Wednesday. But due to winter vacations, the court has not taken any cognizance of it.

The lawyers termed the CBI’s closure report in the murder case as the failure of judicial system.

“Police and other investigation agencies are a part of the Indian judicial system and had the case been solved the image of the system would have improved,” said S.P. Chaudhary, a Ghaziabad lawyer.

“It seems the final report would be challenged in the court of law but the case again would go to the same agency that failed to work out it earlier,” said Surendra Rathi former bar association president of Ghaziabad.

“There is a very bleak prospect of the case being solved even after a further order for the investigation by court,” said Rathi.

“The court has the jurisdiction to monitor the day-to-day proceedings in the investigation. It should have exercised its power in this case,” said a senior police officer on the condition of anonymity.

Aarushi, the daughter of dentist parents Rajesh and Nupur Talwar, was found murdered mysteriously in their Jalvayu Vihar apartment in Delhi’s suburban Noida May 16, 2008. The family’s domestic help, Hemraj, whom Noida police initially suspected for the murder, was also found killed a day later on their flat’s terrace.

Aarushi’s father was arrested and kept behind bars for 50 days in connection with the two killings, but he was later let off because of lack of evidence.
